IMPORTANT NOTICE: These Terms apply exclusively to users residing in the United States who opt in to or use the Text Message Service. If you reside outside the United States, these Terms do not apply to you.
- Acceptance of Terms & Consent. By "Opting In" (which means requesting, joining, signing up for, or otherwise consenting to receive text messages) to or using the text messaging program ("Text Message Service") from GOG, you accept these Text Messaging Terms & Privacy Notice (“Terms”). By consenting to receive text messages from us, you also agree to our main User Agreement and Privacy Policy incorporated herein by reference.
- E-Sign Disclosure & One-to-One Consent. By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. To access and retain this electronic record, you will need a device with internet access. In compliance with applicable telecommunications guidelines, your consent to receive SMS messages is specific to GOG and does not extend to third-party businesses or affiliates.
- Program Description & Data Collection. We collect personal information that you provide to us when you engage in SMS messaging with us, which may include your mobile phone number, messages exchanged during the conversation, and interaction data (such as message delivery status and any links you click within our messages). We collect this information only when you explicitly opt in to the Text Message Service. You may opt in by: (1) entering your mobile phone number and confirming your consent via our dedicated website forms, during account registration, or during the checkout process; (2) sending a mobile-originated text message or keyword to us; or (3) utilizing any other method we may provide where you explicitly grant your consent to receive these messages. To provide personalized cart reminders, we may utilize cookies or similar website tracking technologies to detect incomplete checkout sessions. When you opt in to the Text Message Service, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., cart reminders, sales, new releases) from GOG at the cell number used when signing up. Consent to receive marketing text messages is not a condition of purchasing any goods or services.
- Message Frequency & Costs. Message frequency varies depending on your interactions with our services. We do not charge you for the messages you receive via the Text Message Service; however, standard message and data rates may apply. You are solely responsible for any fees or charges incurred from your mobile carrier related to SMS communication. Depending on your plan, you may be charged by your wireless carrier or other applicable provider. Wireless carriers are not liable for delayed or undelivered messages.
- Opt-Out, Help & Number Changes. If you no longer want to receive text messages, you may reply to any text message from us with the keyword STOP or UNSUBSCRIBE. After unsubscribing, we may send you one final SMS message to confirm your opt-out. Please note that the opt-out process may take a brief period to become fully effective. During this period, you may still receive some messages from us. For assistance, you can reply with the keyword HELP, or reach out directly to our customer support team at support@gog.com. Important: If you change or deactivate your mobile phone number, you must opt out of the Text Message Service prior to doing so.
- Text Message Service Privacy & Security. We respect your privacy. These Terms supplement our general Privacy Policy and apply specifically to the processing of data within the Text Message Service. In the event of any conflict between this section and our general Privacy Policy regarding your SMS data, the provisions of these Terms shall control.
- How We Use Your Information. We use the information we collect through the Text Message Service for the following purposes:
- To Provide the Text Message Service: To transmit mobile messages, including automated promotional messages and personalized cart reminders, based on your opt-in consent.
- To Improve Our Services: To analyze user interactions, message delivery rates, and click-through data to optimize our SMS campaigns for relevance and performance.
- To Respond to Inquiries: To process and respond to your keyword requests (such as "HELP") and provide customer support related to the messaging program.
- To Comply with Legal Requirements: To process opt-out requests (such as "STOP") and comply with applicable telecommunication laws and regulations.
- Data Sharing & Disclosures. We may share your information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. Important notice regarding data sharing: No mobile information (including your phone number and SMS consent data) will be shared with, sold to, or disclosed to third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent will be kept strictly confidential. We do not disclose your personal information to third parties unless required by law.
- Data Security, Retention & Record-Keeping. We implement industry-standard security measures, including restricted access controls, to protect your personal information; however, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security. We maintain secure records of your opt-in and opt-out requests, including timestamps and the method of consent, in accordance with applicable legal and regulatory obligations. We retain your personal information for as long as necessary to fulfill the purposes outlined in these Terms. If you opt out of receiving messages, we will stop sending you communications and may delete your SMS data after a reasonable period, subject to our legal and regulatory obligations. To exercise your rights to access, correct, or delete your personal data, please refer to our main Privacy Policy.
- Changes to these Terms. We may periodically update these Terms. We will notify you about significant changes by placing a prominent notice on our site or through other communication channels (such as via a text message or email, where applicable) at least 30 days before the changes take effect. Your continued participation in the Text Message Service after such changes constitutes your acceptance of the updated Terms.
