1. About Patrons Terms
1.1. GOG Patrons is an ongoing paid service provided to you by GOG through which we are giving you an additional option to support GOG and our mission to make games live forever, while granting you access to unique materials and news in exchange for a monthly recurring fee. We will call this service "GOG Patrons". Thank you for your support!
1.2. These Patrons Terms (together with the User Agreement – see Section 1.3 below) form a contract between you (we will further call you just “you/your” or “ Patron”) and GOG sp. z o.o., Jagiellońska 74, 03-301 Warsaw, Poland (“GOG” or just “us/we/our”) which covers your use of GOG content and GOG services and third-party services (if any), provided to you as part of GOG Patrons (we will call these together “Patrons Services” and this contract “Patrons Terms”).
1.3. Patrons Terms are incorporated by reference into the GOG User Agreement available here (“User Agreement”) and together make up the entire agreement between GOG and you relating to GOG Patrons. All defined terms not defined here in Patrons Terms have the meaning given to them in the User Agreement. In case of a conflict between the User Agreement and Patrons Terms, Patrons Terms will to that extent prevail.
1.4. The range of Patrons Services may vary by location and age and change from time to time, but the then-current range of available Patrons Services is always as described/available at the GOG website where GOG Patrons can be purchased.
1.5. To access GOG Patrons, you must have a valid and active GOG account that is not restricted (for example temporarily banned) and accept the User Agreement and Patrons Terms. If you are over 16 but under 18, you need parental consent to accept Patrons Terms and the User Agreement. If you are under 16, you cannot have a GOG account or become a GOG Patron, because legally we cannot handle personal data of children without a special parental or guardian’s permission (but your parents/guardians are welcome to become Patrons themselves).
1.6. As a GOG Patron, you may have an opportunity to provide your opinion, feedback or any suggestion or idea for improving or otherwise modifying GOG Patrons or any other GOG services or GOG content (“Feedback”) - this is totally optional, but we love to hear your thoughts. However, just so we’re clear, we don’t have to use or accept Feedback and we won’t owe you anything (financially or otherwise) regarding Feedback.
1.7. As a GOG Patron, you acknowledge that your GOG username, profile image and Patron status may be used to identify you as a supporter of GOG services or GOG content, including in promotional materials. Selected content you post within GOG services may be used by GOG to showcase community engagement, in connection with GOG’s mission and in accordance with our Privacy Policy and applicable law. You can object to such use at any time by contacting us (see Section 7 for contact details).
1.8. Additional terms from GOG or its Partners may apply to certain Patrons Services and will be available upon access of such Patrons Services.
1.9. Subject to any applicable statutory rights you may have under the law of your jurisdiction, your GOG Patrons access is personal to you, non-refundable and non-transferable. No other person will have rights to enforce any of Patrons Terms.
2. Start of GOG Patrons
2.1. Patrons Terms are concluded between you and GOG at the moment when you confirm your intention to enter into a binding agreement by clicking on the ‘Start recurring payment’ button or equivalent. By doing so, you enter into a legally binding agreement with GOG for the provision of the Patrons Services.
2.2. Patrons Services will be made available to you immediately upon the conclusion of your order, unless otherwise stated during the ordering process. By confirming your order, you expressly request that we begin supplying the Patron Services to you immediately after the conclusion of the order. As per section 5.1 below, you also confirm and accept that you have been informed, prior to the commencement of the performance, that you’ll lose your right of withdrawal once the supply of the Patrons Services begins and you acknowledge and accept this.
2.3. We will send you a confirmation of your order and information regarding your GOG Patrons to the email address assigned to your GOG account.
2.4. Please note that some Patrons Services may have additional access requirements, such as a need to create an account on GOG Partner’s platform.
2.5 Remember to keep your GOG Patrons order number and the confirmation sent to the email address associated with your GOG account. They may be helpful in case you contact us or want to manage your GOG Patrons.
3. Term, renewals, price and billing
3.1. If you choose to join GOG Patrons, your commitment will be for an initial fixed term (one month). Then, GOG Patrons will automatically renew for successive equal billing periods (monthly) unless you cancel as described in Patrons Terms.
3.2. By confirming your order, you agree to recurring charges of the payment method you selected, until you cancel your GOG Patrons. This includes the payment method selected when placing your order or any payment method later selected through your account settings.
3.3. Your GOG Patrons will automatically renew and be charged on a specific billing date indicated in your GOG account settings and the emails sent to you. If your payment is unsuccessful, we may make up to two repeated attempts to charge your chosen payment method. If these attempts fail, your GOG Patrons will be terminated and you will lose access to Patrons Services. You can change your payment method by selecting the relevant option in your account settings. Your new, selected payment method will be charged starting from your next renewal.
3.4. Information about your upcoming renewal date and next payment due date is available in your GOG account settings (here). We may also send this information to the email address associated with your GOG account linked to GOG Patrons.
3.5. The GOG Patrons price will be displayed at the time of your order. Depending on your location, the price will be inclusive of the applicable tax, or the applicable tax rate will be added at checkout as indicated there. You may be offered a free trial - if it happens, you will be informed about it at the time of your order. You will not be charged during the trial period, however you will be required to add your payment details for future charges. Once the free trial ends, your GOG Patrons will automatically renew for successive, paid billing periods as described in Section 3 here, unless you cancel before the trial period ends.
3.6. The price of GOG Patrons may change. GOG will let you know at least one full billing period before any price change is effective. Please remember that you can cancel anytime if you do not agree with any price change.
4. Cancelling your GOG Patrons
4.1. You can cancel your GOG Patrons at any time and for any reason, by visiting the GOG Patrons management panel in your GOG account settings and clicking “Cancel monthly support” or equivalent there. We will also provide you with a link to the GOG Patrons settings in the emails we send to you in connection with your status as Patron.
4.2. After cancellation, you will still have full access to all Patrons Services until the end of the billing period in which you cancelled. After that GOG Patrons period ends, you will no longer have access to the Patrons Services, effective at the end of your current billing period.
4.3. The above does not limit your rights granted to you under the mandatory provisions of the law of the country in which you reside.
4.4. We will send you the GOG Patrons cancellation confirmation to the email address assigned to your GOG account.
4.5. Please note that information about your then-current support as Patron - in particular your GOG username and avatar - may continue to be displayed in connection with GOG alongside GOG games you helped us support, during the period in which your GOG Patrons was active, as a form of recognition and appreciation of your support. You can always decide to have your details not included - just let us know (see Section 7 for contact details).
5. Agreement withdrawal. No refunds.
5.1. If you are a resident of the European Union, United Kingdom, or other applicable jurisdictions (excluding the USA), then you generally have the statutory right to withdraw from a purchase of GOG content (including GOG Patrons) within 14 days of your purchase, without giving a reason. To exercise the right of withdrawal, you should inform us of your decision to withdraw from this contract by an unequivocal statement. You can, for example, send us an email to support@GOG.COM, or a physical letter at an address set out in Section 23 of the User Agreement. You may use the model withdrawal form attached at the end of Patrons Terms, but you do not have to. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. However, the above does not apply where you have expressly consented to the performance of Patrons Services beginning immediately upon conclusion of the purchase process and GOG Patrons activation and have acknowledged the loss of your withdrawal rights.
5.2. Please note that our Voluntary Refund Policy does not apply to GOG Patrons and, subject to applicable law (for example, if a refund is due to you because we have breached your statutory rights as a consumer), your GOG Patrons is non-refundable (though you may cancel it at any time, as explained in Patrons Terms).
6. Changes to the Patrons Terms and GOG Patrons
6.1. We reserve our right to change Patrons Terms and any rules related to GOG Patrons, including in particular its functionalities or the manner in which it is used, in particular when one of the following happens:
a) a change in the provisions of law affecting the mutual rights and obligations of you and GOG - in particular (but without limitation) with respect to the provision of electronic services, the supply of digital content, or the processing of personal data - or a change in their interpretation resulting from decisions of administrative authorities, courts, market regulators, or industry recommendations;
b) technological or organisational changes affecting the way GOG services in general or GOG Patrons in particular is/are provided (like the need to adapt to new operating systems, devices or browsers);
c) the addition, modification or removal of GOG Patrons functionalities, if this affects the scope or the manner GOG Patrons is offered;
d) changes in the agreements, licences or terms of GOG partners that affect the scope of services provided to you (like changes in the offered digital content);
e) the need to resolve ambiguities, gaps or interpretative uncertainties in the Patrons Terms that may affect their uniform interpretation or application;
f) the expansion of GOG Patrons availability to new channels, platforms, markets or regions;
g) changes to GOG’s identifying details, including contact details, company name, or corporate representation.
6.2. GOG will inform you (Patron) of any material changes to Patrons Terms with at least 30 days before they are planned to enter into force and apply to you, by publishing the new version of Patrons Terms on GOG’s website and sending an email notice to the address associated with your GOG account stating the effective date of the amended Patrons Terms. For existing Patrons, the amended Patrons Terms will apply from the first renewal after the 30-day notice period has ended. If your GOG Patrons renews before then, the previous Patrons Terms will continue to apply until your next renewal.
6.3. In some cases, for example if a change to Patrons Terms involves a new feature, we may provide you with the option (e.g., via a button) to voluntarily accept the updated Patrons Terms earlier. If you do this, you gain immediate access to the new feature, and the updated Patrons Terms will apply to you right away instead of from the date on which they would otherwise apply to you. You will be informed about the possibility of accepting the updated Patrons Terms early and about the effect of such early acceptance beforehand.
6.4. Due to legal obligations or decisions from authorities requiring a faster implementation, changes to Patrons Terms may take effect sooner than the standard notice period described in Section 6.2 above. In such cases, we will inform you of the reason for the shortened notice and the effective date.
6.5. If you do not accept the amended Patrons Terms, you have the right to cancel your GOG Patrons at no additional cost before the changes come into effect. In such a case, your GOG Patrons will terminate at the end of the billing period during which the cancellation was submitted. If you do not cancel by the effective date when the changes come into force, we will treat this as your acceptance of the amended Patrons Terms. You can cancel your GOG Patrons by following the rules set out in Section 4 of these Patrons Terms.
6.6. We also reserve our right to stop providing GOG Patrons at any time. Same as with changes to GOG Patrons, we will inform you about it in advance and GOG Patrons will be available to you until the end of your current billing period - unless we are unable to continue providing GOG Patrons for this long, in which case we will refund you for the unused part of your billing period.

8. Governing law and other legal stuff
8.1. Unless otherwise stated in Patrons Terms, for matters not regulated in Patrons Terms, the provisions of the User Agreement shall apply.
8.2 Patrons Terms are available in several languages. In the event of discrepancies, the English version shall prevail.
8.3 We will only process your personal data as described in our Privacy Policy.
For users resident in the European Union, United Kingdom and elsewhere in the world (but not the USA):
8.4. Subject to Section 8.5 below, you and we agree that your use of GOG Patrons and Patrons Terms will be governed by and interpreted according to the laws of the Republic of Poland and that any dispute regarding this Agreement will be heard non-exclusively by the courts of the Republic of Poland. In any legal claim under Patrons Terms and/or the User Agreement, the side which wins will be entitled to its legal fees and expenses.
8.5. The above choice of governing law and jurisdiction is subject to, and will not deprive you of, any mandatorily applicable principles of consumer protection or other law in your jurisdiction of residence which would otherwise be available.
For users in the USA only:
8.6. You and we agree that your use of GOG Patrons and Patrons Terms, will be deemed to be entered into in Los Angeles, California and governed by and interpreted according to the laws of the State of California, USA (and, if applicable, US federal law). Any legal claim by you against GOG will be made exclusively in any state or federal court located in Los Angeles, California, which will have subject matter jurisdiction regarding the dispute between you and us and therefore we both consent to the exclusive jurisdiction of those courts. In any legal claim under this Agreement, the side which wins will be entitled to its legal fees and expenses.
